Supreme Court upholds murder conviction of Vegas man

CARSON CITY -- Omar Robles, who killed an innocent bystander during a gun fight with drug dealers in Las Vegas, won’t get a new trial.

The Nevada Supreme Court has upheld the first-degree murder conviction of Robles, 28, who is serving a life term at the state prison in Ely, where he is under close supervision.

Robles was convicted of the murder of Nazarios Rios-Olivera, the owner of an apartment complex, who was putting away his daughter’s bicycle. Robles was firing at Ricardo Barragan, who was dealing drugs with two others at the complex on Aug. 24, 2001.

Robles had tried to rob the gang group days before, a shootout ensued and Robles fled. He then returned with another man three days later and started firing, wounding Barragan and killing Olivera.

Robles, in his appeal, argued that he was restricted at trial from questioning David Mayo, one of the other two who were dealing drugs. He said he wanted to question Mayo about his prior criminal convictions.

The Supreme Court agreed there was an error in not permitting further questioning of Mayo but said it was harmless. Robles was permitted to refer to the 2002 and 2000 convictions of Mayo but was stopped from examining earlier felonies or Mayo’s habitual offender status.
