Court denies injunction in Yucca Mountain case

A federal appeals court has denied Washington state's injunction request to bar the federal government from continuing to dismantle a nuclear project in Nevada.

The Energy Department wants to withdraw its application to build the Yucca Mountain nuclear waste repository 90 miles northwest of Las Vegas. The Nuclear Regulatory Commission is considering the proposal, but Washington and South Carolina are among those suing to prevent the government from killing the project.

The U.S. Court of Appeals for the District of Columbia ruled Monday that Washington state had not demonstrated it would suffer irreparable harm if the injunction wasn't granted. However, the court granted an expedited review of the consolidated cases. A hearing is scheduled for September.
