Appeal planned over Scott Ashjian’s U.S. Senate candidacy

The Independent American Party says it will appeal a judge's ruling to allow Tea Party of Nevada candidate Scott Ashjian to remain on November's ballot.

Attorney Joel Hansen on Thursday said an appeal of District Judge James Russell's ruling will be filed with the Nevada Supreme Court.

Ashjian's candidacy for the U.S. Senate seat held by Harry Reid was challenged by Independent American Party candidate Tim Fasano, who is also running for the Senate.

Documents show Ashjian was a registered Republican when he filed his paperwork for the minor party candidacy in March. He didn't change his voter registration until later the same day.

Russell ruled Ashjian "substantially complied" with state election law and could remain on the ballot.

Ashjian's candidacy is denounced by grass roots tea party activists.
