16-year-old pleads guilty to reduced charges in teacher death case

Sentencing set for Sept. 23 for Daniel Carrillo in connection with robbery, beating death of Eldorado High teacher

A 16-year-old boy who is one of six people accused in the October robbery, beating and eventual death of an Eldorado High School teacher is expected to be sentenced to at least 10 years in prison for his part in the slaying.

Daniel Carrillo, who was set to go to trial this week on charges of murder and multiple felonies in the death of Timothy VanDerbosch, a 50-year-old physics and chemistry teacher, has pleaded guilty to reduced charges.

Carrillo pleaded guilty to 11 felony charges, including second-degree murder for VanDerbosch's death. He had originally been charged with 24 felonies, including murder with a deadly weapon.

Carrillo will be sentenced at 9 a.m. Sept. 23 by Clark County District Judge Jennifer Togliatti.

VanDerbosch died Oct. 20, 2010, after he was allegedly chased, robbed, beaten into unconsciousness and run over by a truck while he was walking to Eldorado High School.

The indictment alleges VanDerbosch was robbed using a firearm and/or a knife and hit and/or kicked in the head and body, causing him to fall into the road, where he was fatally struck by a truck. He died at University Medical Center.

Carrillo, who was charged in five separate incidents that occurred during the early morning of Oct. 20, 2010, entered into an agreement to plead guilty to one count of second-degree murder, five counts of conspiracy to commit robbery, four counts of robbery with the use of a deadly weapon and one count of battery with the use of a deadly weapon.

The battery charge was is in connection with the robbery and stabbing of Scott Schraeder during the Oct. 20 robbery spree. Schrader was stabbed in the leg when he was robbed and attacked by the group.

The lowest sentence Carrillo could hope for in the plea deal is 10 years. Second-degree murder carries either 10 to 25 years in prison or 10 years to life in prison.

Under the agreement, prosecutors will not oppose a sentence of 10 to 25 years on the second-degree murder charge, but will retain the right to argue for consecutive time on the other charges.

Each of the five conspiracy to commit robbery charges carries prison terms of from one to six years.

Each of the four robbery charges carries a prison term of from two to 15 years in prison. The weapons charges on each of those four robberies carries between one and 15 years in prison. The weapons enhancement has to run consecutively to the corresponding robbery charge.

The battery with the use of a deadly weapon carries a prison term of two to 10 years.

Chief Deputy District Attorney Robert Daskas confirmed the plea agreement, but said he could not comment on Carrillo's case or on the other five pending cases.

Marison Diaz, 16, another defendant, is apparently working out a plea agreement with the district attorney’s office. Her trial date set for earlier this month was canceled and a status check for her to possibly change her plea was set for 9 a.m. Aug. 29.

The other defendants have all asked to be tried separately.

Marcos Coronel Castrejon, 20, will have his trial at 10:30 a.m. Sept. 6, while Bridget Lugo, 20, will have her jury trial at 10:30 a.m. Dec. 5.

The two defendants facing the death penalty will go last: Saul Farvela, 19, will have his trial at 10:30 a.m. March 5, 2012, and David Rosas, 20, will have his trial at 10:30 a.m. April 9, 2012.
