Boulder City Council found in violation of open meeting law

CARSON CITY — The Boulder City Council ran afoul of Nevada’s open meeting law in hiring its finance director last year, the state Attorney General’s Office said Monday.

The legal opinion said Mayor Rod Woodbury and three council members met privately Sept. 21, 2016, at the Boulder Dam Hotel with Huyn Kim, who was selected by the city manager as the finance director.

The council, at a public meeting Oct. 11, 2016, concurred with the recommendation of the city manager.

The opinion, written by Chief Deputy Attorney General Brett Kandt, said the private meeting was to deliberate on the appointment of Kim before taking a final public vote. Kandt said the private meeting “violated both the spirit and letter” of the open meeting law.

Kandt directed the council to acknowledge the violation at its next meeting. The attorney general also “strongly recommends” council members and staff receive training on the requirements of the law.
