Man, 40, accused of sexual contact with minor

A 40-year-old man accused of sexual contact with a girl less than age 14 is facing various sex assault, lewdness and kidnapping counts, according to a Metro Police arrest report.

Elmer Alberto Aguilar was arrested Monday and booked at the Clark County Detention Center on seven counts of sexual assault with a minor under 14, and two counts each of lewdness and kidnapping, jail logs show.

The alleged incidents were reported by the victim’s mother, who learned about them from a family member, police said.

Aguilar and the girl met at a family-oriented party in mid-March and began exchanging messages, the girl told detectives, according to the report. He showed up at her house when her parents were gone the next day and they had sex, police said.

From then until mid-April, police allege Aguilar and the victim twice more engaged in sexual acts in his house, incidents in which he offered her alcohol, police said.

The lewdness counts are for two alleged incidents in which Aguilar and the girl kissed near his car, and the kidnapping counts were filed due to Aguilar picking up the girl from school, police said.

The girl said she was afraid he wouldn’t take her home after the first time he picked her up because she didn’t know him that well, police said. Aguilar once gave the girl a birth control pill.

The girl told detectives that she felt regretful and that her intentions were not to have sex with him, but only to talk, police said. Those conversations included Aguilar telling her that he didn’t love his wife anymore, police said.

Aguilar, who is jailed on a $295,000 bail, is next scheduled to appear in court on June 2, court records show. It wasn’t immediately clear how old the girl was at the time of the incidents.
