Judge resets hearing on possible plea deal for girl charged in teacher’s death

A Clark County judge on Wednesday granted a continuance for what was expected to be a hearing for a plea agreement for Marisol Diaz, 16, who is one of six young people charged with murder and robbery in the death last year of Timothy VanDerbosh, a Las Vegas high school teacher.

District Judge Joseph Bonaventure reset the status check hearing for 10 a.m. Sept. 28. She is one of the youngest of the defendants indicted for murder and numerous felonies in five separate robberies and attacks.

Those include the attack that led to the death of VanDerbosch, a 50-year-old Eldorado High School physics and chemistry teacher. VanDerbosch died when he was hit by a truck after being attacked on the morning of Oct. 20, 2010, while walking to school.

Chief Deputy District Attorney Robert Daskas said there was nothing he could say on the record about the status of the case, other than the hearing has been rescheduled.

Although Diaz, who is in custody, was brought to court Wednesday morning, neither Daskas nor Robert Langford, who is Diaz’s attorney, were in the courtroom when the judge announced the continuance.

The indictment against the defendants says the teacher was robbed using a firearm and/or a knife and hit and/or kicked in the head and body, causing him to fall into the road, where he was fatally struck by a truck. He died at University Medical Center.

One of the defendants, Daniel Carrillo, 16, has made a plea agreement rather than going to trial and is scheduled to be sentenced at 9 a.m. Sept. 23 by Clark County District Judge Jennifer Togliatti.

Carrillo had been charged with 24 felonies, including murder with a deadly weapon, but pleaded guilty to 11 felonies, including second-degree murder for VanDerbosch’s death.

Bridget Lugo, 20, will have her jury trial at 10:30 a.m. Dec. 5, and Marcos Coronel Castrejon, 20, will have his trial at 10:30 a.m. Feb. 21.

Two defendants are facing the death penalty. Saul Farvela, 19, will have his trial at 10:30 a.m. March 5, 2012. And David Rosas, 20, will have his trial at 10:30 a.m. April 9, 2012.
